Karnataka Hijab Row: Three-Judge Bench To Hear The Petitions On February 10, SC Declines Transfer Plea

By now, all of us know about the Karnataka hijab row that began last month after a group of Muslim students were banned from wearing their headscarves on their college campus. What began with one college soon spread to others leading to a major controversy (rightly so). Recently, a petition was filed in the High Court challenging the hijab ban as a violation of fundamental rights. The petition was heard by the court on Tuesday and Wednesday and the case was referred to the Chief Justice of Karnataka High Court to constitute a larger bench. On Thursday, February 10, a three-judge bench of the Karnataka High Court will hear the petitions on the hijab ban. The bench of Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit and Justice J M Khazi will hear the batch of petitions at 2.30 pm.

On the other hand, a plea was filed in Supreme Court seeking the transfer of the matter from the Karnataka High Court to the top court but the apex court declined to urgently list the matter stating that the High Court will be hearing the matter today. The Supreme Court refused to interfere and also decline to give any specific date in the case.

What Has Happened So Far In The Karnataka Hijab Row?

On Wednesday, a single-judge bench of Justice Krishna S Dixit heard the petitions challenging the restrictions on wearing hijab in educational institutes. As the hearing began, Justice Dixit had said that a larger bench needs to be constituted to hear the petitions as that is usually the case when personal law is involved. A senior advocate appearing for the petitioners had requested the court for interim relief and allow students to attend classes as they are currently not being allowed to do the same. Another advocate had pointed out that this is essential and the matter requires immediate attention as there are only two months left for the academic year to end. On the other hand, the advocate representing the College Development Committee has opposed the plea stating that uniform codes have existed since last year and no one objected to it earlier.

Hijab Row Protests

After the hijab ban in several educational institutes, Muslim students protested against it. Soon after, the educational institutes permitted the students to enter the college wearing hijabs but seated them in a separate classroom. But things did not end there as another group of students wearing saffron shawls began protesting the move. Just ahead of the High Court hearing, the protests turned ugly after the saffron shawl clad protestors began heckling Muslim students trying to enter the colleges. Due to the ongoing protest, Section 144 was imposed in Bengaluru and educational institutes were closed for two weeks.
