Hijab Row: Supreme Court Refuses To Give An Early Hearing Date On The Premise Of Exams Coming Up.

For those living under the rock, the hijab row in Karnataka has now been taken up to the Supreme Court (SC). To say that everyone is eagerly waiting for the verdict, would be an understatement. And it was on Thursday that the SC refused to give any specific date for the hearing of the hijab pleas that challenged the Karnataka High Court’s order. The Supreme Court’s statement came after advocate Devadatt Kamat pressed the court to give an early hearing because of the upcoming exams.

On Thursday, March 24, 2022, the hijab row case was scheduled to be brought before the Chief Justice of India for urgent listing. Devadatt Kamat, the advocate on the case, urged the Supreme Court (SC) to give an early hearing since students have their exams coming up on March 28 and those wearing a hijab will not be allowed to give them and as a result, will lose a year.

In response to the plea put forth by the advocate on the hijab row case, Chief Justice of India, NV Ramana, said, “Exams have nothing to do with the issue. Don’t sensitise.” Earlier also the SC had declined the request for hearing the appeal urgently and postponed the matter to after the Holi break.

As per reports, many students who missed their exams owing to the hijab ban will not be allowed for re-exams. BC Nagesh, the Karnataka education minister, said no re-exams will be taken for those who skipped exams as there is no such provision. He further said, “Whatever the Court has said, we will abide by it. Being absent from exams will only be the prime factor and not the reason, whether it may be because of hijab row or ill-health or inability to attend or for not having studied. In the final exam- absent means absent- repeat exams cannot be held.”

Meanwhile, the three judges of the Karnataka High Court who upheld the ban are given Y category security after they complained of receiving death threats.
