What Is Idaho’s Anti-Abortion Law And How Has It Taken After Texas ‘Heartbeat’ Act

Idaho has now become the first state in the US to make anti-abortion laws which goes after Texas ‘Heartbeat’ Act which essentially bans abortion after fetal cardiac or embryonic activity was detected. The Idaho laws ban abortion after 6 weeks of pregnancy. The difference between the two laws is that Texas doesn’t allow abortions in case of rape but Idaho has exceptions in the cases of rape and incest. Idaho is now the newest state to push some legislation that restricts abortion rights. Other states that have enforced these laws such as Arizona, Idaho, Minnesota, Ohio, Wisconsin, Alabama, Florida, Maryland, and Missouri.

According to sources, the announcement regarding the anti-abortion law by Idaho has come before US Supreme Court is expected to make a decision about the landmark Roe versus Wade judgment of 1973 which claimed that unwarranted restrictions on abortion by the state are unconstitutional. Last year in December, the Supreme Court with a which has a conservative majority that the landmark judgment might be overturned.

The Idaho bill which is also called SB 1309 states that abortion on a pregnant woman is not allowed after a  43 fetal heartbeat except if it is due to medical emergencies. SB 1309 allows the family members of the person who got an abortion to sue the abortion providers if done after 6 weeks or after a heartbeat is detected. Moreover, medical providers who knowingly or unknowingly induced, performed or attempted an abortion will be fined $20,000 for violating the law.

However, in the case of the Texas law, ordinary citizens are incentivised to enforce the law. Citizens are essentially encouraged to report those that get abortions against the law by giving them  $10,000 in damages apart from attorney fees.
