Uttarakhand Court Suspends Gov Orders Of 30% Quota For Women With Domicile In State Service Exams, Says Its Contrary To Article 16 (2)
Reservation based on any and every criteria has always been a topic of debate. Well, both the for and against sides have their own reasons to support the cause. Adding to this list of debates, the Uttarakhand court in a recent judgement has stayed the order of the Government that gave quota to the women based on the domicile status in the State Civil Service examinations. During the case hearing, the court also stated a strong reason for the judgement and how it was contrary to Article 16 (2) of the Indian Constitution.
Uttarakhand court came to this decision while dealing with a Writ petition filed by some students who were not residents of the state but had appeared for the State Civil Service Examination. Their petition highlighted the fact that despite scoring higher marks than women with domicile status, they were still not allowed to appear for the final examination.
While the hearing of this case the Uttarakhand court stayed the orders of the government to give 30% reservation to women with domicile status. The court backed up its judgement by stating that the orders went against Article 16 which says that no citizen of the country shall be discriminated against their race, sex, caste, gender, or residential place when it comes to given opportunities in employment under the state. However, the court also cleared the air of doubts and stated that instead of this a reservation would come into place that would not discriminate against domicile status or the place of residence of the women, as per an article.

The reservation orders were passed by the Uttarakhand government in the year 2006 in affairs of public employment.
