Madras HC Reduces Sentence Of Minor Victim’s Rapist From 10 To 3 Years. And The Woman Must Suffer Lifelong!

I believe that the way women’s safety in India is handled is laughable. Despite having as many rape and assault cases as we do, it is nonsensical how courts don’t take most of these seriously. And this happens regardless of the age of the victim. Somehow, we don’t even believe that young girls being unsafe is an issue For example, in the case of the rape of a 16-year-old girl, Madras High Court has reduced the sentence of the rapist under undisclosed circumstances. Does any reason justify a crime this gruesome?

The Madras High Court has noted that the High Court can sentence the accused in a gang rape case to imprisonment of either sort for a term of fewer than 10 years if there are sufficient and specific reasons to be cited in the ruling. Four people who were charged with raping a young child in 2006 received sentences from the HC of three years of solitary confinement instead of the original 10 years.

The criminal appeal by Palani, S. Jayakumar, S. Manibarathi @ Varadarajan, and P. Gopinath, who sought to overturn the verdict and sentence handed down by a Mahila court here in March 2013, was partially allowed by Justice G. Jayachandran, who made the comment and lowered the punishment.

In the first week of December 2006, the absconding Saravanan lured a 16-year-old girl who wanted to be an actress to a home in Kolathur. This case involved the Anti-Vice Squad in Chintadripet. She met Jayakumar (A 1) and Palani (A 1). (A2). They brought her cold drinks, which she drank and took to being semiconscious. She was assaulted sexually by all three. It was repeated in the following cases as well as Manibharathi and Gopinath became acquainted with the matter and were added as defendants.

The four were detained by the Anti-Vice squad in response to a tardy complaint from the victim girl’s family. The trial court later found the four guilty of an offence under Section 376 of the IPC and sentenced them to ten years of solitary confinement with a fine of Rs 15,000 each in March 2013. thus the current appeal.

The judge partially upheld the appeal, stating that it was proven beyond a reasonable doubt that appellants 1 and 2 participated in the gang rape of the victim girl together with the missing accused Saravanan. As a result, the accused are subject to punishment under Section 376(2)(g) of the IPC, which carries a minimum 10-year term. The court can, however, issue a sentence of imprisonment of any sort for a term of fewer than 10 years if there are sufficient and unique circumstances, which must be indicated in the ruling, the judge noted.

Regarding Manibharathi, the judge stated that the sexual assault on the victim girl was committed alone at his home and did not constitute gang rape as defined by Section 376(2)(g) of the I.P.C. Similar to Gopinath (A4), who was charged in the FIR with raping Ramu (A6) in a lodge close to Puzhal. The judge stated that the aforementioned Ramu is not a defendant in this case and that the Ramu case has been separated.

The judge said that through the testimony of the witnesses, the prosecution has established that these appellants committed the crime with the assistance of the fugitive accused Saravanan, who in a sense served as a pimp and took advantage of the victim girl for his own financial gain. These appellants had succumbed to temptation and had indulged in carnal pleasure…with the young girl. It was further added that since the accused in Sec. 313 of the CrPC proceedings did not claim to be unaware of the victim’s age and had simply refuted incriminating evidence as untrue, it is inferred that they knew about the presumption. The sentence of 10 years R.I. is reduced to three years R.I. with a fine of Rs. 15,000/-, and in default, a sentence of six months simple imprisonment.

Recently, the news came out that a man from Jabalpur, Madhya Pradesh raped a minor and was out on bail and he went. He raped the same girl who is now 19 years old while holding a knife to her. His friend filmed the whole thing. This is one of the many examples of the monsters the women of our country live amidst. Why are the ones we can keep away from the women being given freedom is beyond me?
