Indian Wives Are “Possessive”, Can’t Share Husbands: Allahabad HC Dismisses Discharge Plea Of Man Accused Of Abetting Wife’s Suicide

Over the years, we’ve come across several cases of married women committing suicide due to the cruelty and stress caused by the husband and the in-laws. And being someone who has been married and deals with the family drama that comes with it, I can tell you, that the struggle is real. Adjustment problems aside, it’s hard for women to deal with husbands who fail to understand them and indulge in infidelity. I strongly believe that any relationship is based on honesty, loyalty and trust and when your partner chooses to lie to you and hide the truth and break your trust, it can be more than just heartbreaking. But the woman, in this case, had it worse. In the case of abetment of suicide, a wife died by suicide allegedly because her husband was going to marry another woman without divorcing her. The Allahabad High Court held that the man was responsible for abetting his wife’s suicide.

In this case, the man accused of abetting his wife’s suicide had filed a discharge application in the Allahabad High Court. Upholding the order of the Trial Court, the Allahabad High Court Dismissed the discharge application. According to a report by LiveLaw, the court held that the accused had married for the third time and that was the sole reason behind his wife’s suicide. It further noted that for a wife, her husband secretly marrying another woman is ‘sufficient reason’ to commit suicide. Stating that Indian wives are “literally possessive” about their husbands, the court noted that it would be the biggest shock for a married woman to find out that she has to share her husband with another woman or that her husband is marrying someone else. “In such an awkward situation, it would be impossible to expect any sanity from them. Exactly, same thing happened in this case too, where soon after coming to know that her husband got married in a clandestine way with some other lady, by itself is more than sufficient reason to commit suicide,” said the court.

In this case, the deceased lady had filed an FIR against her husband Sushil Kumar and his family in 2018 under sections 323, 494, 504, 506, and 379 of the IPC. She had alleged that her husband was already married to another woman and had two children without divorcing her and he had married for the third time. She also accused her husband’s family of misbehaving with her as well as torturing and abusing her. The woman filed an instant FIR against her husband and his family after their atrocities crossed all limits and her husband deserted her for another woman. Soon after filing the FIR, the woman committed suicide. After hearing the case, the Allahabad High Court noted that the FIR was filed by the woman as soon as she found out about her husband’s marriage and then committed suicide just the next day, this is why the FIR could be considered as the woman’s dying declaration.

TBH, we agree with the court that this is a case of abetment of suicide but calling Indian wives “possessive” might just be going a tad bit too far!
