SC Rejects Plea Seeking Women Not Be Asked To Use Prefixes, Says It’s A Choice. Is It Though?

Thanks to patriarchy, we live in a world where women are defined by their relationship with a man. It’s Miss when they’re unmarried and Mrs when they’re married while the men continue to remain Mr irrespective of their marital status. Recently, a plea was filed in the Supreme Court which highlighted this matter and stated that no woman should be asked to put prefixes like ‘Ms’, ‘Kumari’ and ‘Mrs’ before their names. However, the Top Court dismissed the plea after stating that the plea has been filed for “publicity”.

A bench of Justices SK Kaul and A Amanullah was hearing a plea which sought that, women should not be asked to use prefixes like ‘Ms’, ‘Kumari’ and ‘Mrs’ before their names. Hearing the petition, the Supreme Court noted that a general order cannot be passed in the matter as the usage of prefixes is a matter of choice meaning that every person has the right to choose whether to use a prefix or not. In response, the counsel for the petitioner sought permission to file more documents in the case. However, the Top Court dismissed the plea questioning what the petition is for and what relief the petitioner is seeking. The Apex Court further stated that “this is all publicity” while dismissing the petition.

While I agree that no law or case law can be made to prevent a person from exercising their right to choice even if it is for something as simple as using a prefix. However, we cannot ignore the fact that married women are forced to use a prefix that makes their existence about their marital status. The second a woman gets married, the prefix before her name changes to Mrs whether she likes it or not. Every document, every form, and every place pushed the woman to use that prefix. How is that fair? Can a married woman use the prefix Miss or Ms before her name without any legal repercussions?
