Hijab Row Petitioners Request Permission To Wear Headscarves Of Same Colour As Uniform

The hijab row in Karnataka government schools and colleges is the biggest debate in the country right now. The most recent update on the matter is that those that have petitioned against the row have requested that they be allowed to wear hijab’s of the same colour as their uniform when they attend these educational institutes. 

Petitioners against the hijab row have argued that Kendriya Vidyalayas run by the centre allows for Muslim girls to wear hijabs of the same colour as their uniform and they would like to be permitted for the same. The plea was made in a memo format and was placed before a full bench which comprises Chief Justice Ritu Raj Awasthi, Justice J M Khazi and Justice Krishna M Dixit who are hearing a batch of petitions filed by Muslim girls against the hijab row done in lieu of school uniform code violation. 

Senior Advocate Devadatt Kamat told the full bench that Muslim girls are allowed to wear scarves matching the bottoms with a red hem on corners. He added that Kendriya Vidyalayas allow this despite the uniforms and it has been a tradition throughout the country that government institutions allow hijabs. “Headscarves for Muslim girls and headgear allowance for Sikhs. This is in line with Article 25 of the Constitution,” said Kamat.

Senior Advocate Devadatt Kamat, who is appearing on behalf of the petitioners against the hijab row said that words in the government cannot have 2 meanings. He pointed out that while the state claims that the words savrajanik suvyavasthe does not mean “public order”, Kamat refutes it. He says that the Kannada translation for savrajanik suvyavasthe is in fact  “public order” and is surprised that the State made this argument at all. “I am not only challenging the GO but also asking for a positive mandate for allowing me to wear a headscarf of the same colour of the uniform,” Kamat reportedly said.
