Bombay HC Refuses To Grant Bail To 72-Year-Old Man Accused Of Raping A 11-Year-Old Girl

Just last week, we did a post talking about all the landmark rulings that prove that Indian courts are now rallying behind women and ensuring our problems are heard and solved. Today, we talk about another ruling made by the Aurangabad bench of the Bombay HC that left us delighted. You see, the bench refused bail a 72-year-old man who accused of raping an 11-year-old girl. As outraged as I feel about this entire case, this ruling leads me to believe that there is a glimmer of hope for justice. Which is a lot more than I can say about a lot of rape cases. 

You see, the 72-year-old man was booked under the POSCO act for the rape of an 11-year-old girl. The court said that the man was the age of the girl’s great-grandfather and if the crime is proved, it will amount to “heinous crime”. And hence, the Aurangabad bench of the Bombay HC dismissed his bail plea. 

Additional Public Prosecutor P V Diggikar told the court that the FIR was lodged by Jalgaon police on May 26, following which the girl’s statement was recorded. According to the complaint, the victim and the accused are next-door neighbours. The 72-year-old man sexually assaulted the minor when her parents, who are farm labourers, were not at home. And then he did it the next day as well.

However on 25th May, upon finding the girl home alone again, he tried to enter her house again. But she screamed and called out her aunt, forcing the accused to flee. And then the girl’s family lodged an FIR against this man. 

This is gruesome and unbelievable. A 72-year-old man sexually assaulting an 11-year-old girl. It’s disgusting. However, the fact that the girl mustered the courage to fight back and get help is incredible. 

The bench observed, “We have gone through the statement of the victim, which is quite explicit and being a girl of a tender age of only 11 years, she has narrated all events in detail when she was interrogated by the police. If the offence is proved, it would amount to a heinous crime. The appellant is a nearly 70 years old man and the victim, going by the social pattern of villages, is practically of the age of his great-granddaughter.” 

While dismissing the man’s bail plea, the court took into account the young victim’s feelings. The bench said, “Taking into account the factors recorded and in view of the fact that the trial in the matter would commence, setting the appellant at liberty would send a wrong signal, in as much as, the victim is likely to be terrorized if the appellant was to roam around free.” 

I really appreciate that the court refused this man bail. The minor girl would be absolutely terrified if her assailant was walking free. Not to mention that it would set a very dangerous precedent. It’s very nice to know that our courts care about the kind of message they are putting out there. This is yet another landmark ruling by the Bombay HC, and we love how the court handled the entire incident. Young or old, men who prey on girls and women need to be held accountable.
