Delhi HC Seeks Serious View Of False Cases Against Husbands To Prevent Misuse Of Law

Whenever we speak about stricter laws to ensure women’s safety and ensure that their rights are protected, some men come out and speak about how those are later on used falsely against them. Now, there’s no denying that there are some women out there who do misuse their gender to file false cases against men – this is especially true when the two are bound by marriage. There have been many instances where wives have falsely accused their husbands of wrong doings and misused the law for their benefits. And so, keeping that in mind, the Delhi High Court (HC) recently said that a serious view needs to be taken of instances wherein false cases are filed against husbands and their families so as to ensure that the social fabric is not ruined.

 

On Tuesday, Delhi HC said that there needs to be a serious view on incidents of false cases against husbands and their entire families so as to ensure that the social fabric is maintained. The court also said that this step needs to be taken so that there is no further misuse of the law.

The Delhi HC made this observation after hearing a case wherein a false incident of suicide of a woman was reported and a case of cruelty was filed under provisions of Dowry Prohibition Act against the husband and her in-laws. It was seen that the woman was still alive and false information of her suicide was given so as to file a case against the husband and the in-laws who were later arrested. The husband’s mother had filed another case against the wife alleging that she and her family members hatched a conspiracy against them to extort money. 

Following this the wife’s brother sought for an anticipatory bail which was denied by the Delhi HC seeing the seriousness of the case. Especially after seeing that criminal proceedings under Section 364 of IPC (kidnapping or abduction in order to murder) were falsely initiated in the case.

As per reports, Justice Anoop Kumar Mendiratta of Delhi HC who was hearing the case said, “I am of the considered view that a serious view needs to be taken of such incidents to ensure that social fabric is not ruined by such fabrication of facts. If false implication by fabricated omnibus allegations against entire family in the course of matrimonial disputes and differences, is allowed, it may lead to further misuse of the process of law and assume serious proportions.”

The high court also noted that the woman was in touch with her family members during the period when her husband was in custody. And that the matter was highlighted in the media due to the presence of an alleged suicide note – which the prosecution is seeking to recover.
