Kerala HC Calls Out Vilification Of Wives, Says Young Generation Thinks Of Wife as ‘Worry Invited For Ever’. Someone Finally Said It!

Statements made in a court are quite significant because we as citizens look up to the law, for justice and fairness. However, there are some instances where we really do not agree with a judgement or statement made in the court of justice because of various reasons, or maybe sometimes they are so intriguing that it makes us think too in a certain way. A court proceeding in the Kerala High Court raised some similar feelings. It was during a divorce plea, during the court made some other observations about the institution of marriage and how it is fading with time. The Kerala HC also stated about the rise in live-in relationships and shed their strong views on it. Nevertheless. the High court bench also brought to light the change in the perspectives of respecting a wife and put forth some well-framed views on it.

The Kerala High Court bench of two-judges Justice A. Muhammed Mustaque and Justice Sophy Thomas heard the divorce plea filed by the husband. The petitioner was seeking a separation based on the fact that after his wife suspected him of having an extra-marital affair, she started behaving in an abnormal way that caused mental and physical illness to the husband. In a remarkable judgement on the case, the Kerala HC bench observed that the wife behaving in a certain way after suspecting her husband’s extra-marital affair cannot be termed as “behaviour abnormality”, rather is normal human behaviour which in no way is a ground to seek divorce. The court clearly stated that if the husband is guilty of an affair, the court shall not give him any aid.

However, the court also observed the changing outlook of people about marriage in recent times. The Kerala HC bench stated that the idea of a wife being a “Wise investment for life” is now changing to “worry invited for ever”. Blaming the youth for wanting to live a life without responsibilities and obligations, the court noted that they are running away from the institution of marriage. Instead, live-in relationships are increasing, as per the source. The bench also expressed disappointment over the fading sanctity of marriage nowadays, and the idea of getting separated for any reason.

Well, the judgment in the divorce case is much-appreciated. The court made it clear how these days women as wives are not given the level of respect they deserve. Although the concept of live-in relationships still being looked down upon might be questionable.
