Karnataka Government Tells HC That Right To Wear Hijab Doesn’t Fall Under Article 25

With the Karnataka hijab row being the biggest source of news in India these days, the developments on the case are coming in faster than ever. Just earlier today we got the news of Karnataka HC denying interim relief to 2 college students to wear hijabs in the class. Now the news has rolled in that the Karnataka government has made the argument that the right to wear a hijab does not fall under article 25.

On Thursday, the Karnataka government made the argument that there are only reasonable restrictions subject to institutional discipline when it comes to wearing hijab in India. Advocate General Prabhuling Navadgi challenged the girl from Udupi who had challenged the restrictions on wearing hijabs in educational institutions. Navadgi pointed out that the right to wear a hijab falls under the category of 19(1)(A) and not under Article 25 as challenged by the petitioners. 

France, where headscarves are completely publicly banned, was cited by Navadgi. However, he clarified that citing France does not equate to disregarding the existence of Islamic religion within India. He claimed that he is citing France to point out and question if the hijab is a necessity. He also added that while there is no ban on wearing hijab in India but every institution has its own rules and regulations.

In regards to the case of the murder of a 26-year-old Bajrang Dal worker named Harsha which happened in Karnataka’s Shivamogga on Monday, 4 people were arrested while dozens of others were taken into custody.
