Hijab Row: Karnataka HC Refuses Interim Relief To 2 Degree College Students Who Sought Permission To Wear Hijab To Classes

The controversy regarding the hijab row in Karnataka has had a brand new development. What, you ask? Well, two students in Karnataka went seeking directions from college to get permission from Karnataka High Court (HC) to wear hijab to classes. However, Karnataka HC refused to give the students interim relief to them on the grounds that the Full Bench governs the ongoing issue at present and so cannot be given relief by a single bench. 

A single-judge bench of Justice Krishan S Dixit refused to grant interim relief to two-degree college students of Bhandarkar College of Arts and Science, Udupi, who sought directions from college to allow them to attend classes wearing a hijab. The bench observed that the interim order that was passed by Full Bench on February 10th, 2022, takes precedence over the issue and so interim relief cannot be granted by a single bench.

As per reports, the Karnataka HC said, “The interim order granted by the Full Bench on 10.02.2022 in W.P.No.2347/2022 and connected matters serves the cause of justice, as rightly submitted by learned AG… When important questions of law are being debated before the Full Bench on a day to day basis, no other interim relief can be granted to the petitioners except the one granted by the Full Bench, in the fitness of things, petitioners arguably being the students of Degree Colleges.”

The interim order that was passed by Full Bench that Karnataka HC was referring to stated that looking at all the pending petitions, the bench has refrained all students “regardless of their religion or faith from wearing saffron shawls (Bhagwa), and connected matters scarfs, hijab, religious flags or the like within the classroom.”
