Former BJP MLA Kuldeep Senger Has Been Acquitted In Unnao Rape Survivor’s Accident Case

The rape cases against minors keep piling up with multiple of them coming up every day. This was also seen in 2017 when a tragedy occurred in Unnao, Uttar Pradesh where a minor was gang-raped. Kuldeep Senger, former BJP Member of Legislative Assembly, was later convicted for the rape in December 2019 and was sentenced to life imprisonment. Before being convicted for this heinous crime, Senger (along with three policemen and five other individuals) accused her father and tried to frame him as the perpetrator. And when that failed, he allegedly threatened the victim and her family. He was also found guilty of the death of the victim’s father in judicial custody.

This case caused outrage among the masses when it was widely reported in April 2018. The Supreme Court ordered the case to be moved from a trial court in Uttar Pradesh to Delhi’s Rouse Avenue court. Delhi court discharges Kuldeep Senger in the subsequent Attempt to Murder accident case in relation to the survivors of the Unnao Rape Case. He walked out, unscathed by the law, citing prima facie no charges were made out against him, following the investigation conducted by the CBI. 

In July 2019, a truck rammed into a vehicle with intent to murder. The vehicle was travelling to Rae Barli, carrying the rape case victim, her lawyer and two aunts. This “accident” gravely afflicted the rape victim and her lawyer whereas the aunts succumbed to their injuries. The prosecution made a case against the former BJP politician,  Kuldeep Senger, stating that he colluded with the five accused to threaten the victim or her family. However, due to the lack of evidence against him, the court dropped the charges, according to reports.

The order cited him being in judicial custody (with no way to conspire) when the alleged threat was delivered to the victim or her family. Furthermore, the court stated that since he didn’t directly extend the threat himself, he is not guilty of the charges made against him. The court, however, charged the other four accused- Ashish Kumar Pal, Vinod Mishra, Naveen Singh and Haripal Singh, as there was sufficient evidence against them. Pal was charged for the punishable offence of causing death by negligence (Section 304-A), causing grievous hurt by endangering life or personal safety of others (Section 338), rash driving in a public way (Section 279). The other three were charged for the punishable offence of threatening to cause death (Section 506 (ii)) of the IPC along with Section 34 for common intention.

Considering the fact that  Kuldeep Senger was convicted of rape and the death of the victim’s father, it is highly likely that he would have been involved to some extent, with this “accident”. Just because he was in judicial custody doesn’t mean he couldn’t have conspired. And the fact that he got away with it is just a shame! A complete shame! Having said that, the meticulously conducted CBI investigation does state evidently he did not collude with the other four accused.
