The Delhi court has granted an interim protection to Naga Chaitanya against the unauthorized use of his image, name, voice, likeness and other personal attributes on pornographic sites, online merchandise websites, and YouTube, marking a huge victory for the actor. This comes after Naga Chaitanya filed a case that accused some websites of reportedly using his identity to share AI deepfakes, pornographic content, and unauthorized products that exploited his identity. As per the media reports, the Delhi High Court held that Naga Chaitanya has established a prima facie case for the grant of an ex parte ad interim injunction after considering the pleadings and documents on record. The court mentioned that he was a popular actor with a career spanning over 15 years, adding that during this time, he had earned a goodwill reputation and public recognition. Furthermore, the court noted that his image, name, and persona constitute a valuable commercial asset built over the years of his effort on his professional front. It’s worth noting that Naga Chaitanya’s personality rights extended to the protection of the name, likeness, image and voice, with Delhi HC adding that no third party could use the said attributes without authorisation.

The court reportedly stated that certain defendants allegedly sold merchandise with the actor’s name and image without permission, which resulted in creating an impression of endorsement or affiliation. It was also mentioned that if those products were of low quality, they could end up damaging Naga Chaitanya’s reputation and goodwill. Further, the defendants were asked to take down the said content and follow its directions within 24 hours of receiving the order. Additionally, the court also restrained the defendants from selling or helping sell the product that unlawfully used Naga Chaitanya’s name, image, or other personality traits. Google LLC was also asked to remove specific YouTube videos and Shorts that allegedly violated his personality rights. The restraint extends to the use of AI, generative AI, machine learning, deepfake AI and face morphing tools.
