From Amitabh Bachchan To PV Sindhu, These Celebrities Filed Civil Suits Against Illegal Usage Of Their Names, Voices And Characteristics!

We all are guilty of being heavily influenced by celebrity-endorsed products. When we see a famous and well-known personality advertising a particular product or service we naturally prefer it over other available options in the market. This is because we attach a sense of faith to the celebrity which is extended to the product or service they are advertising for. Therefore it has become important for celebrities to protect their images, voice, etc from being used to advertise something to which they didn’t agree.

Recently Mr Amitabh Bachchan, a very well-known actor and host of the show Kaun Banega Crorepati (KBC), filed a civil suit in the Delhi High court seeking protection of his name, image, voice, or physical attributes. Mr Bachchan sought a restraining order against book publishers, T-shirt vendors, and mobile applications running lotteries and associating themselves with Kaun Banega Crorepati (KBC). He decided to file this case because of an ongoing lottery scam being conducted by some people using his characteristics. He rightfully argued that he has built a brand of himself that the public associates with “quality” and “trust”. The Delhi High Court recently passed an order restraining any third party from using actor Amitabh Bachchan’s name, photo or voice without his permission.

But, he isn’t the only celebrity who had to rush to the courts for legal aid and justice on this matter. This isn’t the first time a celebrity had to file a case in court to protect his or her personality rights. Our beloved Thalaiva and the evergreen actor Rajinikanth received a favourable order from the Hon’ble Madras High Court in a case of infringement of celebrity rights. He filed the case when his alias name was used without his consent in the title of the film Main Hoon Rajinikanth. The Court upheld the importance of protecting pseudonyms as a part of personality rights and gave the order in his favour.

The late Arun Jaitley, a well-known Indian politician and attorney, had in the past initiated a suit in court against a domain name (www.arunjaitley.com) which was using his name, on the grounds of misuse of his well-known status. In this case, also the court gave an order in favour of the protection of personality rights.

3. Gautam Gambhir

The famous cricketer Gautam Gambhir claimed infringement of his personality rights in his name when he found out that there was a restaurant chain running with the tagline ‘by Gautam Gambhir’ while he had absolutely no connection with the said restaurants. But the court said that his name was not being commercialised here or affecting Mr Gambhir in his field and hence no action was taken.

Sonu Nigam had also filed a case against Mika Singh and OCP Music. In this case, the court restrained Mika Singh and OCP Music from, in any manner, publishing the impugned advertisement which violated the personality and image rights of Mr Sonu Nigam.

Many brands were using images of the Olympic medalist Badminton player PV Sindhu to promote their own products or services, which is a violation of her rights. Later Baseline Ventures, the agency managing commercial contracts of PV Sindhu sent legal notices to over 20 companies, for making unauthorised use of her name/imagery in their advertising.
