Woman Can Be Prosecuted For Gang Rape For Facilitating The Act Of Rape, Rules Allahabad HC

One of the many reasons why crimes against women are on a rise in our country is because these alleged culprits don’t fear the law. Despite strict rape laws in the country, such men dare to rape a girl, woman or even a baby girl. In many cases, even women are involved in plotting this shameful crime, and making a clear stand on the punishments for them, the Allahabad Government gave some noteworthy statements recently. These points of clarification were made during a recent hearing of a case against a woman allegedly accused of being a part of a gang rape in 2015.

The applicant, Suneeta Pandey who submitted an appeal to High Court argued that she should not be summoned in a gang-rape case by the trial court because she was a woman. And she put across this point on grounds of section 376-D IPC. However, the bench presided over Justice Shekhar Kumar Yadav and he showed his disagreement with this. He went ahead to clarify that in a gang rape case, even a woman can face the charges if she assisted the accused men in the shameful act. The court also stated that a woman can be charged in a gang rape case under IPC Section 376-D if she provided any kind of support to the men who raped the victim. The justice also gave a clarification on the term “Person” which is generally used when these IPC sections are written. The court maintained that a “Person” means any human being, and it could be a man, woman or even a child. The court also pointed out that in cases of gang rape, the “Intention” of culprits is taken into consideration, and everyone who is involved in the act with the same intention is bound to be charged under this section, as per the news.

Suneeta Pandey has been charged to face trial in a 2015 gang-rape case of a 15-year-old girl. While narrating the ordeal, the victim had not given her name, however, she did mention the involvement of a woman. Even in the chargesheet, Suneeta’s name was not mentioned. Nevertheless, the trial court charged the alleged accused under IPC Sections 376-D, 212, as per the news. The woman challenged this in the High Court.

It’s pathetic that women can even think to help men rape such young girls. Then they have the audacity to go ahead and use their genders to make appeals so to avoid facing punishment for the crime!
