Nirbhaya Case Update: Asha Devi Breaks Down After Court Agrees To Issue Convict Pawan Gupta A New Lawyer. Justice Still Seems Far Off

A mother will do anything for her child, there is no secret there. She will go to the ends of the earth slashing down anyone who causes her child any kind of harm. I think the worst thing for a mother is to outlive her child. That is the kind of pain that never really goes away. How do I know that? Just look into the eyes of Asha Devi, Nirbhaya’s mother. There is this agony and a burning need for justice that not only worries me but has made me respect her tremendously.

We all know who Jyoti Singh aka Nirbhaya is. She is the 23-year-old physiotherapy student who was brutally gang-raped aboard a moving bus by six men and then thrown off naked by the side of the road in 2012. She succumbed to her injuries in a hospital in Singapore a few days after the incident. A recount of that incident even today gives every woman the chills.

This was over seven years and countless candle marches ago, but Jyoti’s rapists are still stalling. Asha Devi, her mother, has been fighting to get the courts to go through with the black warrants that have been issued to the four remaining convicts- Mukesh Singh, Pawan Gupta, Vinay Sharma and Akshay Kumar. But she has been unsuccessful while the convicts continue to play games and exploit loopholes of our judiciary system.

We can’t even begin to fathom what she must be going through. But after holding on and staying strong through so much, she hit her breaking point in court today while pleading for justice for her daughter and it was one of the most hard-hitting moments ever.

Asha Devi got emotional after the court offered to give legal aid to Pawan Gupta. He claims that he does not have a lawyer after he had to let his earlier lawyer go. It must be noted that Pawan is the only one out of the four convicts who has neither filed a curative petition nor a mercy plea.

The Delhi Legal Services Authority provided a list of advocates to Pawan’s father to choose a counsel from. Upon hearing this, Asha Devi broke down and said, “I am losing faith and hope now. Court must understand the delay tactics of the convicts. Now if a new lawyer is provided to convict Pawan he/she will take his/her own time to go through case files,” She further added “I am wandering here and there to get justice for my daughter. These convicts are using delaying tactics. I don’t know why the Court is not able to understand this.”

The presiding judge reasoned with her saying that legal aid is the right of all the convicts until their dying breath. He said, “We can offer him legal aid at best. What are the other options available.”

Asha Devi then said, “I have been asking the court for one-and-a-half years to get their legal remedies cleared. You didn’t issue a death warrant date last time because there was one week’s time given by HC. Now they are here without a lawyer. I am the mother of the victim. I’m here with folded hands asking for justice. What about my rights.”

This seems like a very smart tactic by the convicts to push the date further. Just yesterday, the Supreme Court gave the trial court a green light to issue a new date for the execution of the four convicts. The hearing for this was supposed to be held on 13th February. Now, a day before the hearing Pawan suddenly asks for a new counsel. There’s definitely delay tactics at play here.

The thing is, all the remedies that these four and their lawyers are employing are well within the boundaries of the law. But, this has to stop, it’s been a long, long road to justice and now we are failing Nirbhaya if we push the hanging any longer. These are the same men that raped a woman so brutally, it shook the whole nation. Do they really deserve all this borrowed time they are living on?

Asha Devi is just a mother who will go to the ends of the earth to get justice for her daughter. Jyoti Singh needs justice, seven years is long enough, don’t you think?
