Bombay HC Says It Is Not Mandatory For Qualified Woman To Work, Can Sit At Home Too

On Friday, the Bombay High Court stressed the point that it is a woman’s choice whether she wants to work after graduation or not. This means, that if a woman is a graduate or qualified to work, it is not mandatory for her to go out and do a job if she does not want to. She can well sit at home as well. This was said by Justice Bharati Dangre who was hearing a revision application filed by a man who was asked to pay maintenance to his wife even though she was she had a steady source of income.

Bombay HC Judge’s New Ruling

As per a report by Bar And Bench, Justice Bharati Dangre has said that society has not yet accepted a woman should contribute to the finances of her household. She also added that it is a woman’s choice to work. Justice Dangre further said that just because she is a graduate does not mean she cannot sit at home. She also went on to state her own example by saying that today is a judge and if tomorrow she decides to sit at home, is she going to be asked to work and not sit at home.

The judge said this with regards to a revision application filed by a man who was asked by Pune’s family court to pay for the maintenance of his wife and daughter. The case is such that the man and his wife got married in 2010 but after three years, she began living separately with their daughter. The woman also went on to initiate proceedings against her husband and his family under the Domestic Violence (DV) Act and also filed for him to pay maintenance to them even when she was earning herself.

The husband in this case is claiming that his wife had lied about not being employed when she indeed was. The case has now been adjourned to next week.

With what limited information we have on the case, the verdict at face value seems very sexist.
