A Woman In UP Has Been Sentenced To Two Days In Jail For Making Out In Public.

With a population of close to 134 crore people, India is flooding with people and currently expected to overtake China in terms of population, in the coming years. And considering how over-populous our country already is, sometimes when the justice is delayed, we hope to believe that it is not yet denied. With several hundred thousand cases being filed everyday, most of which keep getting pushed for years, it often so happens that even cases with prime importance, say about murder, rape or felonies, don’t get fast-tracked.

Although, when in a barrage of flooding case files, some of them really instrumental and crucial, when you see a trivial case such as being booked for making out in public gets the court’s attention, you can imagine our disbelief and frustration.

Turns out, a court in Muzaffarnagar has sentenced a woman, 30, to undergo two days of imprisonment for indulging in an obscene act in a public place over four years ago. And this while people and perpetrators accused of real crimes still roaming free, either because they haven’t been caught, or roaming out on bail.

The woman and her four friends were booked under Section 294 of IPC (obscene act in any public place) on September 26, 2016 after they were found touching each other inappropriately in the city’s New Mandi area. A fine of Rs. 5,000 was also placed on the woman booked.

Along with this the woman will also look at serving an additional seven days in jail upon failing to pay the fine, the court ruled. As per the IPC, Section 294 states that “whoever, to the annoyance of others, (a) does any obscene act in any public place, or (b) sings, recites or utters any obscene song, ballad or words, in or near any public place, shall be punished with imprisonment of either description for a term which may extend to 3 months or with fine or with both.”

Of course, the definition of ‘obscene’ here hasn’t been specified, but it widely associated to only PDA, which gives cops, people and the society the power to harass couple, even if all they are indulging in is a simple kiss. This after many people are let off the hook for crimes as bad as robbing, harassing, assaulting or even raping. But go forbid two people kiss on the road off chance, they need to be treated as deadly criminals. This is absurd.
