Imran Khan Asked to Leave India By October 28 After CJP Protest: What We Know So Far

Bollywood actor and Aamir Khan’s nephew Imran Khan has been under fire after he participated in a protest against the Chief Election Commissioner (CEC), Gyanesh Kumar. He will now move the court against the notice directing him to leave India by October 28. For the unversed, he is an American citizen and Overseas Citizen of India (OCI) cardholder. An FIR has also been filed against the demonstration on October 10.

About Imran Khan

The notice is reportedly issued by the Foreigners Regional Registration Office (FRRO) under the Immigration and Foreigners Act, 2025. It has asked questions over the legal basis for an OCI cardholder to leave India to take part in a public protest. This comes after BJP leader Kirit Somaiya questioned if a foreign national holding an OCI card could take part in an “unauthorised agitation.” Sections 7 and 29 of the Immigration and Foreigners Act 2025 have reportedly been invoked by this notice. Section 7 is about the regulation of foreigners’ entry, movement, presence, and departure, while Section 29 deals with the removal of foreigners from India in specified circumstances.

For the unversed, an OCI card does not confer Indian citizenship or the political rights that are available to Indian citizens. However, it is important to note that the legal questions in Imran’s case are the specified grounds given by the authorities for directing him to leave India after participating in the protest. The Citizenship Act, 1955, restricts OCI holders from exercising political rights. But there is no provision specifically listing participation in a public protest as a prohibited activity. The specific legal basis for the notice and conditions applicable to Khan’s OCI card are therefore important to any challenge he may bring.
