Kolkata Doctor Rape, Murder Case: 7 Key Points Proposed In The Anti-Rape Bill Passed By West Bengal Govt

The 31-year doctor’s rape and murder case at RG Kar Medical College, Kolkata created an uproar in the country, with every citizen demanding only justice for the victim. In the wake of this horrific crime, the West Bengal Government led by Mamata Banerjee passed an anti-rape bill called Aparajita Bil on September 3. The state has now become the first to make amendments to the Central laws and has made punishment for laws more strict. Read to know more about everything that is included in the Anti-rape bill.
1. Life Imprisonment
The Aparajita Bill proposes to give life imprisonment to convicts held guilty of gang rape or rape. It also proposes the death penalty for perpetrators accused of rape crimes. However, capital punishment will only be for convicts if the victim is in a vegetative state.
2. Changes In Bharitya Nyaya Sanhita 2023 (BHS)
The anti-rape bill also proposes some major changes in Bhartiya Nyaya Sanhita 2023. It has proposed the implementation of stricter punishment for crimes like rape, gang rape and other related crimes.
3. Punishment For Repeat Offenders
The bill also focuses on giving life imprisonment to repeat offenders, in some cases even the death penalty.
4. Investigations
The Anti-rape bill also proposes that the investigations in such cases should be complete within 21 days and only a 15 extension can be allowed, that too by a senior police officer.
5. Aparajita Task Force
The West Bengal government will also set up an ‘Aparajta Task Force’ which will be a special task force to investigate cases of rape and sexual offences. It will be headed by the Deputy Superintendent of Police.

6. Privacy Rules
The anti-rape bill also focuses on giving 3-5 years of imprisonment and a fine to people who publish or print unauthorised material on court proceedings related rape cases.
7. Fast-Track Court
The Anti-rape Bill primarily focuses on making court proceedings swift in rape-related cases. The bill also makes an effort to reduce the trauma for the victim’s family.
