There is anger, frustration, and hopelessness among the citizens, but now, it looks like there is some hope. The Delhi High Court had granted bail to the BJP MLA Kuldeep Singh Sengar, a r*pe case convict. However, the judgement was challenged by the CBI, and the Supreme Court bench heard the appeal. To much relief, the SC has stayed Delhi HC’s bail order and also stated about the rights that the victim has in this case, including the statutory right to file an SLP. Read here for more.
Supreme Court’s Judgement
The Delhi High Court’s bail judgement on the 2017 Unnao R*pe Case convict was challenged by the CBI and advocates Anjale Patel and Pooja Shilpkar. Solicitor General Tushar Mehta represented the CBI. The Supreme Court bench of Chief Justice of India Surya Kant, Justice JK Maheshwari and Justice AG Masih heard the matter and put a stay on Delhi HC judgement of granting bail to the the convict, a former BJP MLA Kuldeep Singh Sengar. The court also observed that the r*pe convict was held in another case too and was sentenced for 10 years in jail for the homicide of the victim’s father. As per the Live Law report, the SC ruled that the convict would not be released from custody.
For the unversed, the High Court has granted bail to the convict basis that he had spent seven years and five months in prison. Kuldeep Singh Sengar was convicted in 2019, and was sent to life imprisonment for r*ping a minor girl. The Delhi HC’s judgement sparked widespread protests in the country. The survivor and her mother also became a part of it. As per the reports, both of them has put their faith in the highest court of justice in the country.
