Students From 36 Law Colleges Strongly Condemn BCI’s Resolution On Same-Sex Marriage, Call It “Ignorant”
We stan!The same-sex marriage debate that is ongoing in the Supreme Court currently is being closely followed by the country. The petitioners in the case have asked for marriage equality for the queer community under the Special Marriage Act. However, the Centre has strongly disapproved of the demand since Day 1. Recently, even the Bar Council of India passed a resolution against same-sex marriage and even asked the Supreme Court to refrain from taking any decisions on it. Condemning BCI’s resolution, students from 36 law colleges in India have issued a notice. In this, the students have slammed BCI’s insensitive approach to the hearing and have also expressed solidarity against the council.
The student groups from 36 law colleges in India have firmly called BCI’s resolution on same-sex marriage, insensitive and ignorant. In the letter, the students have also reminded BCI to utilise their resources in addressing the more challenging issues at hand to make India’s legal profession better. They also pointed out that BCI’s resolution showed their ignorance towards the LGBTQ+ community. Furthermore, the student groups questioned BCI’s data on 99.9 per cent of the Indians being against same-sex marriage and added that the Council conveniently counted the queer community as the insignificant population.
The student groups took the matter into their hands as future members of the Bar Council and expressed disappointment in the decisions made by their seniors. In the solidarity letter, the groups demanded the council to take back its regressive resolution that was obstructing the community to move forward towards getting their fundamental rights.

On Day 5 of the same-sex marriage hearing, the Solicitor General read the Parliamentary debate that happened during the formation of the Special Marriage Act. He argued that the Parliament was aware of the presence of homosexuals but deliberately refrained from using words like “Parties” and particularly user “Man” and “Woman.”
