The Rajasthan High Court has issued a directive to the state government to create a dedicated web portal for registering live-in relationships. This decision comes in response to a surge in petitions filed by couples seeking legal protection due to threats from their families and society. Justice Anoop Kumar Dhand, who presided over the case, noted that courts are increasingly being approached by live-in couples under Article 226 of the Constitution, requesting protection under Article 21.

Recognizing the growing number of such cases, the court emphasized the need for a structured system to regulate live-in relationships until formal legislation is enacted. The court acknowledged that while live-in relationships may seem modern and appealing, they come with significant legal and social challenges. One of the key concerns highlighted was the legal status of women in such relationships, as they do not receive the same recognition or rights as married women. Additionally, the absence of formal acknowledgment often leads to complications, especially regarding property rights, inheritance, and the welfare of children born from these relationships.

To address these issues, the court suggested setting up competent authorities in every district to oversee the registration of live-in relationships. These authorities would be responsible for addressing the grievances of couples and ensuring legal safeguards for their rights and the rights of their children. The proposed web portal would serve as a platform for live-in couples to register their relationships and seek assistance if needed. The court has instructed senior officials, including the chief secretary and law department representatives, to take the necessary steps for implementation. A compliance report detailing the progress on this matter must be submitted to the court by March 1, 2025.

Additionally, the case has been referred to a larger bench of the high court to determine whether individuals who enter live-in relationships without formally dissolving their existing marriages are eligible for legal protection. This decision could have broader implications for how live-in relationships are legally recognized in India.
