Chief Justice of India DY Chandrachud recently addressed the critical issue of workplace safety for women during the hearing of a rape and murder case involving a Kolkata doctor. He emphasized that the lack of safe working conditions equates to denying women their right to equality. This case, while specific, highlights the broader systemic issue of safety for healthcare professionals in India, particularly women.

The Supreme Court described the rape and murder at the state-run RG Kar hospital as both “horrific” and “horrendous,” and criticized the West Bengal government for its slow response in registering an FIR. In response to this tragedy and the broader safety concerns it underscores, the court has suggested the creation of a national task force. This body would be tasked with developing guidelines aimed at ensuring the safety and protection of medical professionals nationwide.

CJI Chandrachud stressed the importance of implementing a national protocol to safeguard working conditions for doctors, noting the long hours and demanding conditions they often endure. He highlighted that many young doctors, especially women, work shifts extending up to 36 hours, which underscores the urgent need for improved safety measures. In addition to addressing systemic safety issues, the court also called for media discretion regarding sensitive case details. It expressed concern over the widespread media exposure of the victim’s name and images, which could compromise dignity and privacy.

The incident, which led to the victim being found dead after a gruelling shift, involved a civic volunteer named Sanjoy Roy, who has since been arrested and charged with the crime. This case has not only led to legal scrutiny but also prompted a wave of protests among doctors, to whom the court has appealed to return to work, assuring them that their safety and protection are of paramount concern.
