Bombay HC States Woman Booking Hotel Room Doesn’t Mean Consent To S*x, Reinstates Trials Against Rape Accused!

The world is not a safe place for women and most men are not to be trusted. Yet another alleged rape case proves this. The Bombay High Court has passed a very important statement on the matter after a trial court found the alleged not guilty of the crime. The Bombay HC firmly stated that a woman booking a hotel room does not mean that she gave the man consent to have s*xual activities. Read on to know more.
Bombay High Court’s Statement On An Alleged Rape Case
A Margao Trial Court passed an order in March 2021 which discharged a man of rape allegations based on the fact that the woman has booked the hotel room. However, the Bombay High Court bench led by Justice Bharat Deshpande dismissed the Trial Court’s order and stated that a woman booking a hotel room or entering the room with a man does not imply that she gave him the consent to have s*x with her. The HC bench also called the Trial Court’s statement “an error” and further stated that the court had mistaken two different things: the first was that she booked the hotel room and the other aspect that happened inside the room which should have involved consent.
Talking about the details of the case, the Bombay HC also noted that if the woman had given consent to the activity inside the room, she would not have come out crying and lodged a police complaint immediately. As per the news reports, the woman also alleged that the man had assured her of meeting an agent for a job and therefore she booked the room. However, as per the complaint, the man took her inside the room and threatened to kill her after which he committed the crime.
As per report, the HC court has ordered the trials against the accused to begin again.
