Supreme Court Asks Why Should Unmarried Women Not Be Allowed Abortion Right Like Other Categories

The abolition of the Roe V.Wade Act by the US Supreme Court sparked anger among women across all countries. Depriving women’s right to abortion is like taking away their basic human rights. However, the Indian Supreme Court has rather taken a commendable decision and has indeed raised a valid question in the court of justice. On Friday, August 6, SC observed that an unmarried woman should also get the same rights to abortion as recognised for other categories.

On Friday, the Supreme Court bench of Justices D.Y. Chandrachud and J.P. Pardiwala carried out that they would make some changes to the Medical Termination of Pregnancy Act that deprived unmarried women of abortion rights but that was given to all other categories of women. As per an article, the bench said that it would give unmarried women the right to abort their 20-24 week unwanted pregnancy without making any compromises on safety. Rule 3B of the Medical Pregnancy Termination Act observes the rules for such situations in pregnancy for women who are divorcees, disabled, minors, widows, or rape victims. It does not have any provisions for unmarried women and this was brought to light by the supreme court bench. The bench while making such a remarkable decision also stated that unmarried women could also go through such an unexpected and unplanned pregnancy from any bad relationships,  therefore their right to terminate such pregnancies should also be considered for them.  As per the article, the lawyer who was representing the centre stated that the decision have been put forth after consultation with the experts. The court bench also observed that the rules of the act will also be tweaked to give the right to abort babies in 20-24 weeks to married women whose pregnancy was a result of traumatic relationships and failure of family planning.
