POCSO Court Says That Friend Of Other Sex Isn’t To Satisfy Lust

As someone who has a lot of friends from other genders, this whole concept of a man and woman not being friends never made sense to me. I am lucky enough to have parents who never restricted regarding stuff like this. They never had an issue with my male friends coming over or even staying over for the night if needed. However, I know a lot of my female friends who had (and still have) restrictions regarding being friends with men. While I do not condone this mentality when I read cases like these, I don’t completely blame parents for being worried. Let’s talk about the case of a now 20-year-old man who is being convicted and sentenced to 10 years in jail under the POCSO Act for raping his 13-year-old friend.

After the case of a 20-year-old man raping his 13-year-old friend surfaced, a special POCSO court said that a friend of an opposite gender does not exist to fulfil selfish lust. The 13-year-old was a distant relative who lived in the criminal’s neighbourhood. The court talked about how this heinous act traumatised the young girl and also ruined the man’s life. However, he deserves it. 

Judge Priti Kumar Ghule said, “The sentence of the accused will send a message to youth of today, who are in the age group of (the) accused, that uncontrollable desire for satisfaction of lust can spoil their future, career and golden period of progress,” according to reports. The POCSO court said that the early days are the major foundation for one’s future and youth, regardless of gender. “In (the) present case, future of the accused, as well as the survivor, has come in the shadow of darkness due to the offence committed by accused,” the judge added.

This is where the case takes a turn, for me. The POCSO court said that the man does not need maximum punishment as he has realised the consequences of his actions and will not repeat them. The girl deserves compensation under the District Legal Services Authority. 

I feel like even under something as serious as the POCSO Act, the court’s perspective of this whole situation gave the man too much leniency. He is an adult who raped a minor. I do not understand why this is beind trivialised to the man’s future being ruined. I would have preferred for the judge to question if the man is safe enough to be free in society. Under what basis is the assumption being made that he will not repeat this again is beyond me. It makes me question how seriously this case was taken in the first place.
