Allahabad HC Says Fraud Men Often Use The False Promise Of Marriage To Have Sex With Women

Marriages in India are meant to be sacred institutions. The ones that are taken in the presence of God to bless the couples wanting to spend the rest of their lives together. But there are specific kinds of people that use marriage as an excuse to have sex. There are many cases filed in the country that reveal how a person convinces his/her partner to have sex with them on the pretext of marriage. It is due to that, that the Allahabad High Court (HC) is pushing for a specific law on ‘sex on the false promise of marriage.’ 

Recently, Allahabad High Court has found it necessary to have a specific law that deals with cases where a person attains consent for sex on the false promise of marriage. The Bench believes that cases where the person getting consent for sex based on the false promise of marriage are increasing daily. And that is major because the person thinks that he can easily get away with it.

The Allahabad High Court Bench of Justice Pradeep Kumar Srivastava – on the cases of getting consent for sex by a person on the false promise of marriage – said, “This feudal mindset and male ‘chauhanism’ (Chauvinism) that women are nothing but an object of enjoyment is required to be rigorously addressed and strictly dealt with in order to create a healthier society and to increase a sense of security and protection in the mind of women.”

The stance of the Allahabad High Court is that the reality of our country is that marriage has always been used as a tool by fraud men to emotionally manipulate a woman to give consent for sex. The Court stated, “For the major women population in our society, the promise of marriage is a great allurement and they are trapped in a situation which results in their sexual abuse and exploitation… Needless to mention that false marriage promise is and always, in the major part of our society, has been an effective tool of mischievous males for creating emotional pressure on a woman for doing sex.”

As a woman, I find it absolutely disgusting to know that this is the level some men go to have sex with a woman. As far as I’m concerned I stand by the Allahabad High Court – there has to be a law that punishes a person for obtaining consent on sex on the basis of false promises of marriage. To use deception and ways of cheating to get sexual consent is a crime and somewhere even amounts to rape. The judicial system of India definitely needs to take steps to ensure that more girls and women don’t fall prey to such promises and deception.
