Former NCB official Sameer Wankhede recently filed a defamation suit against Aryan Khan and Shah Rukh Khan for their show, The Ba***ds of Bollywood. But his plea got rejected as the court stated that since the cause of action was not made out of Delhi, his complaint was not maintainable. Sameer Wankhede’s lawyer argued that The Ba***ds of Bollywood’s reach extended to Delhi. They cited that the memes were circulating among Delhi residents, but the court found this insufficient to establish jurisdiction. The court also pointed out that the IRS Officer failed to adequately specify how the civil suit should be pursued in Delhi under Section 9 of the Civil Procedure Code. This plaint was rejected by the judge, but he did allow Wankhede’s legal team to amend the suit, though no specific date for resubmission was provided.
This ruling underscores the importance of establishing proper jurisdiction in defamation cases and highlights the challenges public figures face when seeking legal recourse for alleged defamation in the digital age. They said that had his plea had stated that the maximum amount of reputation damage had happened in Delhi, he wouldn’t have objected.
The court ruled that, after considering Section 9 of the CPC, the plaintiff failed to properly state how the civil suit would be heard in Delhi. When Wankhede’s counsel requested time to make the necessary revisions, the court instructed them to amend their action but did not provide a deadline. “The Registry will give the date once the application is listed,” the court ordered.
