Samay Raina Among Five Stand-Up Comics Ordered To Apologise For Insensitive Disability Remarks By SC

The Supreme Court on Monday, August 25, instructed Comedian Samay Raina and four other stand-up comedians to issue an unconditional apology for their insensitive remarks on disability. Aside from Samay, Vipul Goyal, Balraj Paramjeet Singh Ghai, Nishant Jagdsish Tanwar, and Sonali Thakkar are to extend an apology on their YouTube channels for their offensive remarks as per ANI. Following a hearing held on Monday, the Supreme Court has also called on the government to frame guidelines for social media to control speeches that may offend or ridicule disabled women, children or senior citizens. 

In the hearing, the court also explained its decision to make the social media influencers apologise on their public platforms. Sr Adv Aparajita Singh, who appeared for the foundation, called on the comedians to spread awareness about the issue. In his statement, Singh mentioned, “Let them use their influence to take this issue forward. That would be the best apology.”

What The Petition Read

The petition against the five social media personalities was filed by the CURE SMA (spinal muscular atrophy) Foundation of India. In their petition, the organisation cited insensitive jokes made by Samay Raina, Vipul Goyal, Balraj Paramjit Singh Ghai, Sonali Thakkar, and Nishant Jagdish Tanwar.

In court arguments, the foundation’s side argued that the terms used by Rain and others to mock people with disabilities amount to hate speech. They also showed video evidence of the influencers in which they are seen ridiculing persons suffering from spinal muscular atrophy, a rare disorder.

The petition as per ANI read, “These videos shed light on the widespread irresponsible, insensitive and violate dissemination of such online content that contravenes the rights of the persons with disability under Article 14 and 21 of the Constitution of India, propels offensive stereotypes and misguided portrayals against them, and detrimentally impacts their societal participation, and fosters insensitivity and inhumanity against them, and as such falls within the reasonable restrictions under Article 19(2),” said the petition as per ANI.

Samay Raina has also previously been reprimanded by the Supreme Court for his comments on the comedy show ‘India’s Got Latent’. Back then, Raina and Ranveer Allahbadia were summoned by the High Court for their controversial remarks.
