A New York man has filed a lawsuit against Kim Kardashian after she mistakenly used his photograph in an Instagram post advocating against the execution of a death row inmate. The man, also named Ivan Cantu, alleges that the high-profile mix-up has caused him distress and damaged his reputation.The incident occurred when Kardashian, who has been an outspoken advocate for criminal justice reform, posted on Instagram urging support for inmate Ivan Cantu, who was facing execution in Texas. However, instead of using the prisoner’s photograph, she mistakenly uploaded an image of a completely different individual— a project manager from Westchester, New York, who shares the same name.

Kim Kardashian Sued By New York Man

With Kardashian’s massive social media reach, the post quickly gained traction before the mistake was rectified. Despite its swift removal, the unintended exposure left the New York Cantu facing confusion, unwanted attention, and online scrutiny. Following the incident, the New York-based Cantu has taken legal action against Kardashian in Los Angeles Superior Court. His lawsuit claims that the post subjected him to public ridicule and emotional distress. He argues that Kardashian, as a global influencer with immense reach, should have exercised greater responsibility when sharing sensitive information.

His legal representative, Greg Sobo, emphasized the damaging impact of such errors, stating that social media misuse can cause significant harm, and public figures must be held accountable for their online actions. According to the lawsuit, the situation was particularly distressing as Cantu was already dealing with personal struggles at the time. The complaint seeks unspecified damages for the alleged harm caused to his reputation and well-being.

Kardashian’s legal team has acknowledged the error, describing it as an unintentional mistake. They clarified that the post, which urged followers to sign a petition against the execution, was taken down almost immediately after the mistake was noticed. Despite this, Cantu’s legal team claims they attempted multiple times to reach Kardashian’s representatives for a resolution before resorting to legal action.

Meanwhile, the Texas inmate, Ivan Cantu, was executed on February 28. He had been convicted of murdering his cousin, James Mosqueda, and Mosqueda’s girlfriend, Amy Kitchen, in 2000. Until his death, he maintained that his conviction was based on false testimony and flawed evidence.

As the lawsuit against Kardashian moves forward, it raises questions about the responsibility of celebrities in handling social media advocacy, particularly when dealing with sensitive legal matters.
