NewJeans Secures Major Win In Cyber Harassment Lawsuit, YouTuber Faces Hefty Fines

The Seoul Western District Court ruled against a YouTuber and ordered them to pay 5-7 million KRW to the members of K-pop girl group NewJeans for sharing s*xually explicit videos. On August 11, the court found that Shin’s actions violated the group’s personal rights. And with this, NewJeans successfully won their damages lawsuit against the YouTuber.

As per reports, Shin had two YouTube accounts and used them to produce 20 videos about the girl group. The YouTuber ran these accounts between April and May 2024. and the videos included “s*xual remarks and malicious comments”.

The court stated that Shin’s actions went beyond freedom of speech and violated public morals and social order. Shin’s behaviour was considered a direct attack on Minji, Hanni, Danielle, Haerin, and Hyein and caused emotional harm to the young artists. It also damaged their reputation.

As a result, the YouTuber was ordered to pay 5 million KRW, which is 3.065 lakhs INR to Minji, Hanni, and Danielle, and 7 million KRW, which is 4.291 lakhs INR to Haerin and Hyein.

Earlier, the Seoul Western District Court’s Criminal Division 9 sentenced a stalker of NewJeans to a fine of ₩10 million in the first trial. Prosecutors initially pushed for a 10-month prison sentence. However, the court opted for a fine and added specific reasons for the lighter penalty. The judge mentioned that the accused admitted his wrongdoing during the investigation, which showed some level of accountability.

The fact that he had no prior criminal record also played a role in the decision. These factors led the judge to reduce the punishment from imprisonment to a monetary fine.
